1) Legal disclaimer

Informational only; no advice. Anything on this website or in our communications is provided for general informational purposes only and is not legal, medical, veterinary, or other professional advice.

No warranties; results vary. All products are custom, artistic items made from the photos/details you provide. We do not guarantee any specific outcome or an exact match to any photo, preview, screen display, or expectation. Variations, minor imperfections, and differences in color/appearance are inherent to custom design and 3D printing (including effects from lighting, material blends, print orientation, and finishing).

Site provided “as is.” The website, content, and services are provided “as is” and “as available.” We make no warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, to the maximum extent permitted by law.

Third parties. We may rely on third-party providers (including payment processors, carriers, and platform services) and may link to third-party sites. We are not responsible for third-party content, policies, delays, interruptions, errors, or performance.

Controls. In the event of any conflict, these Terms (including Sections 13 and 14) control. If any part of this disclaimer is unenforceable, the remainder will still apply to the maximum extent permitted by law.

2) Agreement to these Terms

By accessing our website, placing an order, or using our services, you agree to these Terms & Conditions and any policies referenced here (including our Returns & Refunds Policy and Privacy Policy). If you do not agree, do not use the site or place an order.

3) Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to place an order.

4) Products are custom and may vary

Our products are custom-made based on the photos and information you provide. Because each piece is custom, variations and minor imperfections are normal and are not considered defects.

Material note: “Wood,” “Marble,” and “Metallic” filaments are specialty 3D-printing materials/blends and are not necessarily solid wood, stone, or metal. Appearance may vary by lighting, print orientation, and finishing.

5) Order process (photos, preview, approval)

5.1 Photos you provide

You agree to provide photos you have the legal right to use. The quality/angles of photos you submit materially affect results.

​

5.2 Studio preview (digital model)

If your order includes a digital model preview, we typically provide it within 48 hours after we receive sufficient photos and required order details. This timing is an estimate, not a guarantee.

5.3 Revisions

revisions are offered during the print approval process. once print preview is reviewed, if any changes are requested, necessary adjustments will be made an d a new print preview will be provided for sign off. ​

5.4 Approval to print

Production typically begins after you approve the preview (when applicable). If you do not approve, we do not proceed to printing.

​

5.5 Non-response / abandoned orders

If we send a preview and do not receive an approval or revision request within 5 business days, we will send one follow-up email. If we still do not receive a response within 5 business days after that follow-up, we may treat the order as abandoned, cancel it, and issue a refund per Section 9 (minus completed work as described).

6) Pricing, payment, and taxes

Prices are shown in USD unless stated otherwise. You authorize us (and our payment processors) to charge your selected payment method for the total shown at checkout, including applicable taxes and shipping.

If a pricing or listing error occurs, we may cancel the order and refund you, or contact you to confirm whether you want to proceed at the corrected price.

7) Shipping (United States only)

7.1 Shipping destinations

We ship to addresses within the United States only (no international shipping at this time).

​

7.2 Processing and ship times

Production and shipping timelines are estimates and depend on queue volume, material availability, and complexity. We do not guarantee delivery by a specific date unless we explicitly agree in writing.

7.3 Address accuracy

You are responsible for providing an accurate shipping address. If a package is returned due to an incorrect or incomplete address, additional shipping charges may apply to reship.

8) Changes to an order

If you need to change photos, personalization details, or shipping address, contact team@keepsakesbypawpetual.com as soon as possible. We cannot guarantee changes can be made once design/production has started.

9) Cancellations and refunds (custom work)

​

9.1 Before work begins

If you cancel before design work begins, you will receive a full refund.

​

9.2 After work begins, before approval/production

If you cancel after design work begins (including preparation of a preview/model, where applicable) but before you approve and before production begins, you will receive a partial refund equal to 85% of the amount paid (we retain 10% to cover completed work).

9.3 After approval / production begins

Once you approve the preview (or once production begins for orders that do not include previews), cancellations are generally not available, except as required by applicable law.

​

10) Returns, damage, defects, and “not what I expected”

Because each keepsake is custom-made, we generally do not accept returns for change of mind or preference.

10.1 What you must do if there’s an issue

If there is an issue, you must:

• email team@keepsakesbypawpetual.com, and

• provide photos (and any requested details) so we can evaluate what happened.

We handle resolution through a documented conversation between customer service and the customer to determine the appropriate outcome.

10.2 Damage or defect window

To be eligible for a damage/defect remedy, you must contact us within 48 hours of delivery (with photos of the item and packaging).

​

10.3 Remedies (case-by-case)

If we determine an item arrived damaged or is materially defective, we will determine the appropriate remedy case-by-case, which may include repair, replacement, reprint, or refund in whole or in part.

10.4 Return shipping for approved defect/damage claims

If we approve a return due to damage/defect, we provide a prepaid shipping label.

​

11) Customer content and intellectual property

​

11.1 Your responsibility

You represent that you own or have permission to use any photos or content you submit, and that submitting that content does not violate any third-party rights (copyright, privacy, publicity, etc.).

​

11.2 License to fulfill your order

You grant us a limited, worldwide, royalty-free license to use your submitted content only as needed to create the preview/model (if applicable), manufacture your keepsake, fulfill your order, and provide support.

​

11.3 Marketing use (opt-in only)

We will not use your submitted photos or images of your finished keepsake for marketing unless you explicitly give permission (opt-in).

12) Prohibited content

You agree not to submit content that is illegal, hateful, harassing, sexually explicit, or that infringes another person’s rights. We may refuse or cancel orders that violate these Terms or applicable law.

13) Disclaimers

To the maximum extent permitted by law:

• The website and services are provided “as is” and “as available.”

• We do not guarantee the website will be uninterrupted or error-free.

• We do not guarantee an exact match to any photo or on-screen appearance due to the custom, physical nature of the product.

(Some jurisdictions do not allow certain disclaimers; this section applies only to the extent permitted.)

14) Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the site or purchase of products.

Our total liability for any claim will not exceed the amount you paid for the specific order giving rise to the claim.

15) Indemnification

You agree to indemnify and hold harmless Pawpetual LLC / Keepsakes by Pawpetual from claims arising out of (a) your submitted content, (b) your breach of these Terms, or (c) your violation of law or third-party rights.

16) Privacy

Your use of the website is governed by our Privacy Policy.

​

17) Governing law and venue

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles.

Any disputes will be brought in the state or federal courts located in Massachusetts, unless applicable law requires otherwise.

18) Changes to these Terms

We may update these Terms from time to time. The “Effective Date” reflects the latest version. Continued use of the site after changes means you accept the updated Terms.
